Privacy Policy

This Privacy Policy shows you how Swash Franchise Ltd (“we” or “us”) may process your personal information. It also describes your information protection rights, including a right to object to some of the processing which we may carry out. Further Information about your rights, and how to exercise them, is set out in the Choices and Rights sections. This Privacy Policy applies to all Swash Window Cleaning franchisees and franchisee applicants.

 

 

The Personal Information We Collect

We may collect and process the various types of personal information in connection with your role as one of our franchisees (or prospective franchisees).

  • Contact & identification information such as driving license, passport etc

  • Financial information

  • Customer feedback information concerning your performance

  • Any other information you submit to us, including during the course of any communication

From time to time, we may also request certain types of personal information from third party sources, such as listed below:

  • Certifications, training qualifications or results you have obtained from any such course provider.

  • Membership information from various organisations.

  • Credit report information

  • Third party recruitment or similar sites

  • Results of any checks by the Home Office Disclosure and Barring Service (DBS) as required for certain customer requirements and to determine suitability as a franchisee.

When asked, results of any psychological tests conducted during the application process.

What information do we and our franchisees collect or hold?

Personal information is any information which can be used directly or indirectly to identify you. Including for example: 

    • your name

    • date of birth

    • address

    • phone number

    • e-mail address 

    • any device ID (such as your IP address), either by itself or when linked with other personal information.

We and our franchisees might collect, use, store and transfer various types of personal information about you, as categorised below:

  • Identity Information includes first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender.

  • Contact Information includes billing address, delivery address, email address and telephone numbers.

  • Financial Information includes bank account and payment card information.

  • Transaction Information includes information about payments to and from you and other information of products and services you have purchased from us or our franchisees.

  • Technical Information includes internet protocol (IP) address, your login information, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access the website.

  • Usage Information includes information about how you use the website, products and services.

  • Device Information includes the type of device(s) you use

  • Marketing and Communications Information includes your preference(s) of receiving marketing from us, our franchisees, and your communication preferences.

We also gather, make use of and pass on information that cannot be used to identify you such as statistical or demographic information. So as an example, we might look at the the numbers of people visiting various pages of our website or the number of requests from various locations.

 

Why We Collect, Use and Store Such Personal Information

We collect, use and store your personal information for the following reasons listed below. 

  • Where required for Swash Window Cleaning to begin and perform obligations stated in the Franchise Agreement.

    • Assessing your suitability for opening a franchise and negotiating any agreements.

    • Providing you with access to our platforms and services.

    • Referring customers for your area to you if they make contact with us first.

    • Monitoring and managing the services you provide to customers, including any disputes or complaints.

    • To collect funds due to us under the Franchise Agreement.

  • Where necessary to comply with a legal obligation.

    • Carrying out anti-money laundering and any other due diligence checks.

    • Disclosures to law enforcement agencies or in connection with legal claims, health & safety compliance, regulatory, investigative and complaints purposes (including disclosure of such information in connection with legal process or litigation).

  • Where required for Swash Window Cleaning’s legitimate interests, as listed, and where our interests are not overridden by your information protection rights.

  • Managing and developing our franchise network in areas such as performance management, training and development, award recognition, franchisee surveys, marketing to franchisees and to encourage cooperation between existing and new franchisees (including but not limited to prospective franchisees being given the details of existing franchisees to discuss and evaluate the franchise proposition prior to signing a Franchise Agreement).

    • Protecting our legitimate business interests and legal rights. This includes, but is not limited to any use in connection with legal claims, compliance, validating and facilitating trade appropriate accreditations, regulatory, auditing and investigative purposes and other ethics and compliance reporting requirements. 

    • Maintaining the security and integrity of our facilities, equipment and electronic platforms. This includes administering access rights, monitoring compliance with company protocols, and where permitted by local law and in accordance with relevant policies, for investigations.

    • Assessing your suitability to opening and operating a franchise.

    • Operation of any whistleblowing system which Swash Franchise Ltd may run now or in the future.

    • To analyse and monitor the diversity of its franchise network in accordance with applicable laws.

  • Where you have given consent. For instance, we may ask for your permission to use your image in a company publication. Where we ask for consent, you are free to grant or deny it.

How We Share Your Personal Information

We may share some of your personal information with other members of The Swash Franchise Group for instance; to administer and manage group functions, including making systems available to Group employees, to manage centralised systems and to assess your performance and the performance for the purposes of business planning and accounting, and monitoring and managing any customer disputes and complaints.

In relation to such personal information, Swash Franchise Ltd will be the party responsible for it (the “information controller” in legal terms). Your personal information will also be shared with businesses providing services under contract to Swash Window Cleaning, such as training providers, help desk providers, software and IT systems providers and other IT hosting and/or IT maintenance providers.

If mandated by law (or if required for the protection of our legitimate interests in compliance with applicable laws) your personal information will be shared with government authorities and/or law enforcement officials.

In the event that part of the Swash Window Cleaning business is sold or integrated with another business (in part or whole), your details may be disclosed this may be to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business/business unit.

Your Choices and Rights

It is your right to request a copy of your personal information; to correct, delete or restrict processing of your personal information; and to obtain a  structured, machine readable format of the personal information you provide. In addition, you can Oppose of the processing of your personal information in some circumstances (in particular, where we or our franchisees don’t have to process the information to meet a contractual or other legal requirement or compelling interest). You can withdraw consent at any timeWhere you have been asked to give your consent. If you ask to withdraw your consent to us or our franchisees processing your information, this will not affect any processing which has already taken place at that time.

If fulfilling your request would reveal personal information about another person, or if you ask us or our franchisees to delete information which we or our franchisees are required by law or have compelling legitimate interests to keep. Then these rights might be limited. If you have unresolved concerns, you have the right to complain to the information protection authority in the country you stay, work or are otherwise located.

In accordance with applicable law, we and our franchisees will retain your personal information only for as long as we (respectively) need it for our legitimate interests. After such time, your information will either be deleted or anonymised or, if this is not possible (for example, because the information has been stored in backup archives), then it will be securely stored in a form that no longer identifies you and isolated from any further use until deletion is possible.

Your Information Protection Responsibilities

As one of our franchisees, you might receive or access personal information relating to our customers, suppliers, business partners, other franchisees or Swash Franchise Ltd personnel (including those of Swash Franchise Group). As further detailed in the Franchise Agreement and the Manual, we expect you to comply at all times your own information protection obligations in respect of any personal information you receive or access whilst one of our franchisees.
